PMWeb provides powerful tools for managing contractor progress claims and facilitating compliance with security of payment law as it has been implemented in the various States in Australia. PMWeb’s record, workflow and notifications features operate in concert to streamline claims processing.
The High Court of Australia – the supreme court in the Australian court hierarchy and the final court of appeal in Australia – made its first decision in this last week relating to security of payment law – in this case in relation to the Building and Construction Industry Security of Payment Act 1999 (NSW).
The High Court’s judgment in Southern Han Breakfast Point Pty Ltd (In Liquidation) v Lewence Construction Pty Ltd HCA 52 affirms that there must be a ‘reference date’ for the claim to be valid. The reference date is the date on which a claim for a progress payment may be made, as stated in the contract; or the last day of the month if the contract does not specify such a date.
The High Court held that the existence of a reference date under a construction contract is a precondition of making a valid payment claim. Therefore, a payment claim that is not in respect of a reference date will not be treated as a payment claim under the Act. In practical terms this means that a payment claim must be made on the basis of a reference date to be valid under the Act. The absence of a reference date for the claim will provide solid ground to argue the claim is invalid.
PMWeb configuration should include a field to capture the reference date; and the Payment Claim produced by PMWeb should always state the reference date. Workflow configurations can also include validation checks to ensure compliance.
The PMIAA is expected to have a significant impact on Program Management and Project Management – not only in the USA, where the Federal Government spends more than $2.7 Trillion (USD) per year, but around the world, as the Act’s increased standards and resulting compliance requirements flow through all industries to impact organisations that utilise Program Managers and Project Managers.
The demand for effective Program and Project governance, increased controls and transparent access to information by stakeholders will increase the demand for tools that can support these needs throughout the project lifecycle. Solutions that can provide answers in real-world terms, such as PMWeb’s leading features for managing capital works projects, will provide Program Managers and Project Managers with the information necessary for effective decision-making.
Project Owners already have increased requirements for access to information in real time. Some will provide their own system and require that their consultants and contractors use that system – bringing all participants into a common database that the Owner controls long-term. Others will require their consultants – and the Project Manager in particular – to deliver the controls and reporting to new levels.
Project Management companies servicing capital works projects for their Clients in any industry will establish leadership and competitive advantage through the control and reporting systems they bring to the engagement.
After a lengthy review process, CMU chose PMWeb over all other competitors primarily because “Unlike the other software companies, PMWeb clearly understands construction.” PMWeb was designed and built from the ground up by Program and Construction Managers to deliver an all-in-one, easy-to-use project management system.
CMU joins other Universities using PMWeb, including Johns Hopkins, Harvard Business School, Harvard Graduate School of Education, American University, UC Davis Medical, Tufts, Johns Hopkins Hospital, University of Washington, Boston College and the University of Washington St Louis.
